Reflections on Civil Jurisprudence in Luxembourg: The Example of Contract Law

Summary
On the occasion of the upcoming release of the second edition of his Luxembourg contract law manual, Pascal Ancel reflects on the civil jurisprudence in Luxembourg based on the insights gained during the writing of this new version. The first edition was primarily pedagogical and informed solely by published jurisprudence, but the author aims to make this edition more accessible to practitioners, especially to fill the gap left by the lack of a new edition of Olivier Poelmans' work. This goal requires enriching the text with numerous jurisprudential references, including recent ones, leveraging advancements in accessing unpublished decisions. The in-depth research conducted for this purpose, along with efforts related to the preparation of the draft reform project on contract law, enabled the author to gauge the specificity of Luxembourg civil jurisprudence, particularly in contractual matters, compared to the French model. This specificity primarily arises from the decisions themselves, including their structure, drafting, and the sources they explicitly draw from. It is also manifested in the use of these decisions to build a coherent 'jurisprudence,' despite ongoing challenges related to access, dissemination, and the development of a distinct Luxembourgish legal doctrine capable of deriving norms through its commentary and connections.
The presentation will be followed by a debate with the audience, initiated by Mr. David Hiez, a professor at the University of Luxembourg.
